monumental way -- the court could draw some thin lines and make it less profound than we expect but what do you expect regarding trump's immunity claims? >> the week ended well for donald trump and i think it will begin well at the supreme court. what we think is going to happen is some degree of immunity will be granted by the court. we have to go back to the oral arguments. lots of folks on the left factors no way there was going to be granted, even on the right, legal analyst were dubious but oral arguments, we saw clearly most of the supreme court justice indicated there would be some form of that. it's yet to be seen how much there's going to be. it's going to be some sort of new testable have to carry into

the future, neil gorsuch said this is a test for the ages. we have to keep in mind, no matter what the ruling is it will send all of trump's cases back to the trial court where the trial court judge will have to look at the new standard in comparison to the charges that are there. even the recent criminal case could be reassessed whether that should have been brought because those connell charges all occurred while he was in office. i don't think he will get relief on that but it will be a new round of arguments perhaps delaying the sentencing. will: the hope was this would happen before the election, another win for trump. let's talk what happened at the end of the week, you mentioned it was a big week. i want you to help us understand a few of those. they issued an opinion on limiting the january 6th

charges from the people who have been arrested, specifically obstruction of official proceeding charge. >> reporter: those who were charged including donald trump had a major windfall. the supreme court saying specifics of what the interference or obstruction was has to be relatively specific related to documents or other things identifiable as opposed to the catch all phrase under the term otherwise. a lot of folks have pled guilty already. when you plead guilty, you waive a lot of constitutional rights. it will help donald trump with two of the charges in the dc case. how that is dealt with, i think they will see what happens with the immunity decision.

will: there are other charges they are facing but the obstruction of an official proceeding charge. >> that could send them back for resentencing. will: political watchers sense to this was more profound than we could appreciate. the chevron decision limits the administrative state. before chevron, the supreme court allowed the legislative branch the right to write regulations, interpret laws however they like. name your federal acronym, the supreme court said you don't get to write laws at the sec level of government. >> the chevron deference standard is the difference between big government and small government, that's the easiest way to put it.

it said these executive branch agencies were allowed to create any law they wanted where there was ambiguity in the congressional law. the supreme court says that's too far. it is for the legislature to make the laws and the executive branch to enforce them, not make up their own versions. that has tremendous implications primarily for businesses. will: the legislative branch, they can handed over to the executive branch which would use these administrative bodies to fill in the gaps. whether you're a fishermen or anything else you answer to regulations written by agencies, not lawmakers. andrew:there's lots of ambiguities, some intentional, some unintentional, trying to giving state of agencies that authority, others happenstance

our water is so incredibly warm, 6 or 7 degrees above where they would normally be this time of year. that's a problem. we have our first, our second named storm forecast to become the first hurricane of the season. it gets to the caribbean, want to get to the western caribbean, a yucatán peninsula or the gulf, a lot of time to watch this one. the storm behind it, it's pulling into the same area probably as a hurricane, two hurricanes likely in the next week across deep part of the atlantic, doesn't happen this time of year but we are expecting this. rachel: president biden's debate performance in the spotlight earning claims like this one. >> president biden: we significant increased, the

happening at the border, it is upsetting to see it, the country suffering from it, men and women suffering from it. someone needs to acknowledge the problem exists so we get it fixed and we see this administration not acknowledge that. >> the parole program that brought people from haiti and cuba and other countries in the caribbean, there was a haitian that came through the program charged with raping her 15-year-old disabled girl in massachusetts, that girl was released, a $500 bond this week, and ice detainer was ignored as the biden administration is moving to protect hundreds of thousands of haitians from deportation. tell us what you know about this case, your thoughts on this program. devastating the victims of this

ballot. it doesn't go to kamala or somebody else. wisconsin or nevada lose these states are very pivotal but you can't just say we picked the wrong person, we've got to go with this other person. rachel: wisconsin is one of the most critical states, might hinge on that state. you are saying president biden's name is going to be on the ballot no matter what barack obama or schumer say? they can't take it off. jason:they would have to change the law. rfk junior is struggling to get on the ballot. one reason he didn't qualify for the debate is his name isn't on enough ballots to even potentially win the presidency. will: the president is in a
