of of of Pittsburgh Post-Gazette: Friday, February 5, 1993 OBITUARIES Lenny Levy During 1961 season 'Lenny' Levy, former coach for Pirates Leonard "Lenny" Levy, who Leonard "Lenny" Levy, who helped coach the Pirates to the World Series Championship in 1960, died Tuesday in Hacienda de Monterey, Palm Desert, Calif. He was afflicted with heart problems and had had a stroke. Mr. Levy, 79, was a member of the Pittsburgh Pirates organization from 1935, when he was signed to a contract by Pie Traynor, through 1961. Even after that, he performed parttime duty as a bullpen catcher and in other roles during pregame practices.

Mr. Levy, of Rancho Mirage, also owned and operated a Chrysler dealership on Forbes Avenue, not far from Forbes Field, and later on Baum Boulevard from the mid-1960s into the 1980s. Before turning to coaching, the Pittsburgh native was a catcher who played in the Pirates' 1 inor-league organization from 1935 to 1937. He was with the Pirates under managers Traynor and Frankie Frisch from 1938 to 1942, when he went into the Marine Corps for duty in World War II. Mr.

Levy returned in 1947 as a coach under manager Billy Herman and, later, Bill Meyer before serving on the scouting staff from 1951 to 1956. He resumed coaching in 1957 under manager Bobby Bragan, who was replaced halfway through the season by Danny Murtaugh. He was a Mason and a member of Jewish War Veterans Lodge 249. Survivors include a sister, Betsy Stein of Fox Chapel. Services were yesterday in Cathedral City, Calif.

Compiled by Ernie Hoffman Cousin held in fatal shooting A convicted killer accused of walking into the home of his cousin yesterday and shooting him to death was captured four hours later by police who surrounded a building in an Arlington Heights apartment complex. Ronald Banks, 27, of Burrows Street, Terrace Village, was arrested about 8 p.m. in a second-story apartment at 3265 Arlington Ave. About a dozen police cars converged on the three-story building after detectives learned that the suspect was inside.

Banks was wanted in the death of Darnell Dixon, 19, another resident of the complex, who was found face down on a sofa in his apartment at 3245 Arlington Ave. Police said the victim and two friends were drinking beer when Banks entered Dixon's third-floor apartment about 3:50 p.m., pulled a handgun and opened fire. Dixon was struck in the head, police said. Detective Sgt. Fred Wolfe of the Police Bureau's major crimes unit said the shooting was not gang or drug related.

Dixon, found in his living room, was pronounced dead at the scene. An autopsy is expected to be conducted today, the coroner's office said. Banks was awaiting arraignment last night. Banks received a five-to-10-year sentence in the 1987 stabbing death of a drinking companion, Therman Brown, 33, of Terrace Village, during an argument, police said. Detectives, city police and Housing Authority officers surrounded the building after detectives learned that Banks was inside.

William DeWeese brought the hammer down yesterday on several fellow Democrats who recently challenged DeWeese and other House Democratic leaders by pushing for legislative and perk reforms. DeWeese, D- Waynesburg, stripped Rep. Murphy of his committee chairmanship, and bypassed state Rep.

Thomas Michlovic for a committee chairmanship that Michlovic was in line to assume. DeWeese instead awarded the posts to more junior members who supported DeWeese in the House's recent in-fighting. Murphy, D-North Side, and Michlovic, D-North Braddock, were among 13 rebel Democrats who publicly pressed for reforms to the House's internal operating rules last week. DeWeese, along with Majority Leader Ivan Itkin, D-Point Breeze, and most rank-and-file Democrats, wanted to keep the current system of rules. DeWeese announced the shake-up in a press release late None of the principals could immediately be reached for comment.

Democrats control the House 105- 98. In recent weeks, they have been feuding more among themselves than with Republicans, battling over perks, House operating, rules and internal leadership elections. DeWeese in November was elected speaker of the House by his fellow Democrats, ousting former speaker Robert O'Donnell, D-Philadelphia. It was a bitter contest. While there were several issues, one was O'Donnell's public attacks on legislative perks.

Then, last week, Murphy, Michlovic, O'Donnell and 10 other Democrats rebelled against DeWeese, Itkin and the rest of the caucus on a normally routine vote to establish the House's internal operating rules. Itkin last week threatened to cut the staffs of some of the recalcitrant members of his caucus. A compromise was reached Tuesday in which those sanctions were dropped in exchange for a promise by Itkin to form a committee to study the proposed reforms, reporting back March Murphy, chairman of the House Insurance Committee last session, and now a candidate for mayor of Pittsburgh, was stripped of his committee leadership yesterday. Murphy said earlier this week that he expected to lose the post. But he said he thought that it was more a result of his opposition to DeWeese in the speaker's race than it was the House rules fight.

Michlovic, elected to the House in 1978, was given no chairmanship yesterday, although seven members elected two years after Michlovic were awarded committee chairs. O'Donnell, the former speaker elected in 1974, also did not get a committee chairmanship. But Rep. Ron Cowell, D- Wilkins, who had been allied with O'Donnell in the leadership fight, did retain his chairmanship of the Education Committee. Committee chairs get no extra pay, but they get extra staff and substantial legislative clout.

State Rep. Italo Cappabianca, D- Erie, who was one of the 13 dissidents on the rules vote, retained his chairmanship of the Federal-State Relations Committee. Judge refuses to free inmate over plea By Mike Bucsko Post-Gazette Staff Writer A judge rejected a recommendation yesterday that a former North Side man should be freed from prison because his constitutional rights were violated when he pleaded guilty to a murder in 1979. Stephen Heiser, 35, contended that his attorney coerced him into pleading guilty second murder in the shooting William Lear, 52, owner of a Richland antique shop called the Cracker Barrel, in February 1979.

Heiser, sentenced to life without parole, also contended that his constitutional right to due process was violated because a motion he filed to withdraw his guilty plea was not acted on for 12 years. "This case is a sobering reminder that justice is not always swift," Chief U.S. District Judge Gustave Diamond wrote in a 40-page opinion filed yesterday. Diamond ruled, however, that the delay did not entitle Heiser to a new trial or freedom. Diamond's order and the attached opinion rejects a recommendation by U.S.

Magistrate Judge Gary L. Lancaster that Heiser be released be-, cause of the delay. In 1980, Heiser filed a motion to withdraw his guilty plea in Allegheny Common Pleas Court, but Judge Thomas Harper died in 1982 without holding a hearing on the request. The case was assigned to Judge Alan Penkower in 1986, but Penkower never ruled on the motion, partly because he believed Harper had ruled on it, Diamond wrote. Heiser's first appeal, to U.S.

District Court, was rejected in June 1990 without a hearing. The 3rd U.S. Circuit Court of Appeals in December 1991 sent the case back to District Court with an order to schedule a "hearing to determine whether Heiser's allegations about his plea were true. Diamond said the issue as directed by the appeals court was not the inaction on the motion, but what effect the delay had on whether Heiser would be successful. In that respect, Diamond Lancaster had misconstrued the appeals court ruling because Lancaster focused on the due process violation from the delay.

Heiser did not deny that he shot Lear during a robbery attempt. But Heiser contended that he pleaded guilty to second degree murder and robbery only after his attorney sug- gested it.
